Bio

J.J. Kim is the Founding Partner of ACI Law Group, specializing in customs, international trade, maritime and logistics, food safety, and intellectual property law. He represents clients before major U.S. government agencies—including U.S. Customs and Border Protection (CBP), the U.S. Patent and Trademark Office (USPTO), the U.S. Food and Drug Administration (FDA), the Office of the U.S. Trade Representative (USTR), and the U.S. International Trade Commission (ITC)—as well as the U.S. Court of International Trade (CIT) and various federal and state courts.

Mr. Kim’s practice covers a broad spectrum of corporate operations and cross-border transactions, ranging from corporate governance and regulatory compliance to customs valuation, import admissibility reviews, regulatory audits and investigations, anti-parallel importation, food safety, intellectual property rights, and trade remedies. He regularly advises and represents clients on complex matters such as penalties and seizures, liquidated damages claims, cargo disputes, country-of-origin marking, free trade agreements (FTAs), cross-border contracts, international litigation, and alternative dispute resolution (ADR).

In addition, Mr. Kim handles a wide range of commercial disputes, including international trade and transport litigation. He has extensive experience managing litigation and dispute resolution before courts and labor commissions, successfully representing leading Korean conglomerates in high-stakes corporate matters. He has also authored numerous publications on key topics and emerging issues in international trade.

Representative Matters & Trials

  • Represented a U.S. importer facing approximately $2.7 million in civil penalties imposed by U.S. Customs and Border Protection (CBP) under 19 U.S.C. §§ 1526(e) and (f) for intellectual property violations. Strategic representation resulted in a 100% penalty mitigation, fully relieving the client of the $2.7 million liability.
  • Secured favorable decisions in over 500 CBP Protest proceedings involving tariff classification, country of origin, valuation, and preferential duty claims under various free trade agreements—including the KORUS FTA, NAFTA, and CAFTA-DR. These efforts successfully assisted clients in recovering or saving tens of millions of dollars in duties and associated fees.
  • Represented numerous U.S. importers in civil penalty proceedings under Section 592 of the Tariff Act of 1930.
  • Successfully defended an apparel company in state court against trade secret misappropriation claims.
  • Prevailed in international arbitration on behalf of an apparel firm, recovering over $1 million in lost profits resulting from a foreign counterpart’s breach of contract.
  • Represented clients across a broad range of FDA and CBP regulatory matters, including FDA Warning Letters, penalty actions, tariff classification, country-of-origin marking, food labeling, and recordkeeping compliance. Drafted responses to over 500 CBP Forms 28/29, Protests, Petitions against Liquidated Damages claims, and administrative complaints, successfully preventing civil fines and asset seizures.
  • Represented numerous importers in submitting Prior Disclosures to CBP regarding customs violations related to tariff classification, valuation, Merchandise Processing Fees (MPF), and preferential trade agreement qualifications.
  • Advised major U.S. food importers on comprehensive compliance with the Food Safety Modernization Act (FSMA). Assisted multiple importers with establishing Foreign Supplier Verification Programs (FSVP), reviewed overseas suppliers’ HACCP plans, and developed Food Safety Plans for various food manufacturers.
  • Served as Outside General Counsel to a major Korean food manufacturer and importer, advising on overall business operations and regulatory compliance. Established Food Safety Plans and Supply Chain Security Plans, represented the client during FDA and CBP audits, and built comprehensive import compliance programs pursuant to Title 19 and Title 21 of the Code of Federal Regulations (C.F.R.).
